Terms and Conditions
1. Booking & Payment Schedule
- Retainer: A non-refundable retainer of 25% of the total package price is required to secure your wedding date.
- Final Balance: The remaining balance is due in full no later than 14 days prior to the wedding date. Failure to pay the balance by the due date may result in cancellation of services.
2. Coverage & Timeline
- Timeline: The Client agrees to provide a detailed timeline of the wedding day at least one week prior to the event.
- Sole Photographer: David Russell Photography shall be the exclusive professional photographer retained for the event. Guests are permitted to take photos provided they do not obstruct the professional photographer's work.
- Meals: For coverage lasting 5 hours or longer, a meal should be provided for the photographer (and any assistants) to ensure peak performance.
3. Artistic Discretion & Deliverables
- Style: The Client acknowledges David Russell Photography's style is consistent with the portfolio at www.davidrussellphotog.com and agrees that editing is at the photographer's discretion.
- Image Delivery: Final edited wedding images will be delivered within 4-6 weeks via a private online gallery.
- Shot List: While the photographer will attempt to fulfill specific requests (e.g., "shot lists"), no specific pose or image is guaranteed due to the unpredictable nature of live events, weather, and lighting.
4. Cancellation (Wedding Specific)
- By Client: If the Client cancels the wedding, the retainer is non-refundable. Cancellations made less than 30 days before the wedding require full payment of the remaining balance to compensate for the lost date that could not be re-booked.
- By Photographer: In the unlikely event of severe illness or emergency preventing David Russell Photography from performing, liability is limited to a full refund of all monies paid. The photographer will make every effort to assist in finding a replacement photographer of similar skill.
4. COPYRIGHT, USAGE & MODEL RELEASE
(Applies to all session types)
- Copyright: David Russell Photography retains the copyright to all images created.
- Client Rights: The Client receives a Personal Print Release, granting the right to print unlimited copies and share images on social media for personal, non-commercial use.
- Model Release: The Client grants David Russell Photography the right to use images for self-promotion, portfolio, and marketing (e.g., website, Facebook, brochures). If a client wishes to keep images private, this request must be made in writing before the session.
5. LIABILITY WAIVER
The Client agrees to hold David Russell Photography harmless for any personal injury which may occur during the session. In the event of a technical failure (e.g., memory card corruption, camera theft), the Photographer's liability shall be limited to a full refund of the session fee.
